Terms of Use

These Terms of Use ("Terms") govern your use of the EMUFIT mobile application ("App"). The Terms form an agreement between [COMPANY / DEVELOPER NAME] ("EMUFIT", "we") and the person who registers for the App ("User", "you"), concluded when you tick the consent box during sign-up. The Turkish version of these Terms prevails in case of any inconsistency.

1. The service

EMUFIT is a wellness and fitness app offering meal and nutrition tracking, AI-assisted food photo analysis, barcode and nutrition label reading, water, step and sleep tracking, workout programs, nutrition plans, the EMUFIT Assistant and dietitian chat. Some features are only available with a paid membership or a purchased plan.

2. Not medical advice

• EMUFIT is not a healthcare provider and does not provide medical diagnosis, treatment or advice.
• AI analyses, calorie and nutrient values, barcode results, nutrition plans and workout plans are estimates and may be wrong. Do not rely on them as exact.
• If you have a chronic condition, are pregnant, have a history of eating disorders, take medication or have any health concern, consult your doctor or dietitian before starting a nutrition or exercise program.
• If you feel pain, dizziness, shortness of breath or similar symptoms during exercise, stop immediately and seek medical help.
• The in-app dietitian service is general nutrition counseling and must not be used for emergencies or medical treatment. In an emergency, call your local emergency number (112 in Türkiye).

3. Registration and account

• You must be at least 18 years old to register.
• You are responsible for the accuracy of the information you provide.
• You are responsible for keeping your account and password secure. Tell us immediately if you notice unauthorized use.
• Your account is personal; you may not transfer, sell or share it.
• You can delete your account at any time under Profile > Privacy & Security.

4. Rules of use

You agree not to:

• Share unlawful content or content that violates the rights of others; send insulting, harassing, threatening, hateful, obscene or violent content,
• Share another person's personal data, photos or contact details without permission,
• Send spam, advertising or misleading messages to dietitians or other users,
• Decompile, reverse engineer, circumvent security measures or gain unauthorized access to our systems,
• Inflate usage rights (such as AI analysis quota, ad rewards, promo codes) through automated or fraudulent means,
• Bulk-copy the App's data or use it commercially.

The App has a content filter and a reporting system. Content that breaks these rules may be removed, and accounts may be suspended or closed without notice.

5. User content

• You own the photos, messages, profile details and other content you upload.
• You allow us to process this content only to provide the service to you (for example, to analyze a food photo, deliver a message to your dietitian or display your profile). How we process personal data is explained in the Privacy Policy and the KVKK Notice.
• You are responsible for ensuring your content does not infringe the rights of third parties.

6. Memberships, purchases and payment

• Paid memberships (CORE, PRO, ELITE) and nutrition plans are purchased through the App Store or Google Play. Your payment details are not shared with us; payments are processed by the store.
• Subscriptions renew automatically for the same period at the current price unless cancelled at least 24 hours before the end of the period. You can manage and cancel your subscription in your store account settings.
• Refund requests are handled by the store under its refund rules.
• On the free plan, some features such as AI analysis have limited usage. These limits are shown in the App and may change.
• Promo codes grant the stated membership for the stated period. Each code can be used once per account and cannot be exchanged for cash.
• On the free plan you may earn extra uses by watching rewarded ads; these cannot be exchanged for cash or transferred.
• Prices and membership contents may change. Changes do not affect your current billing period and are announced before the next renewal.

7. Intellectual property

The App's design, software, logos, AI models, recipes, articles, workout content, images and other content belong to EMUFIT or its licensors. These Terms only give you the right to use the App for personal, non-commercial purposes.

8. Availability

We do not guarantee that the App will be uninterrupted or error-free. The service may pause temporarily for maintenance, updates or technical issues. We may change, add or remove features. We are not responsible for disruptions caused by third-party services (such as barcode databases, AI providers or app stores).

9. Limitation of liability

To the extent permitted by law, EMUFIT is not liable for decisions you make based on estimated information in the App, for health outcomes of following exercise or nutrition programs, for data loss or for indirect damages. This does not limit liability for intent or gross negligence, or your mandatory consumer rights.

10. Suspension and termination

We may suspend or close your account if you breach these Terms. You may end these Terms at any time by deleting your account. Deleting your account does not cancel an active store subscription; cancel it separately in your store settings.

11. Changes

We may update these Terms. We will notify you in the App about significant changes and ask for your consent again where required.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. As a consumer, you may apply to Consumer Arbitration Committees within the statutory monetary limits, and to Consumer Courts above those limits.
